Writs of error, 1825-1858.

This series consists of writs of error, which are appeals to the Supreme Court of Alabama, to review and preferably alter the decisions made in a lower court (circuit court). If the judgment, sentence, or decree is affirmed in whole, the plaintiff in error shall pay the defendant in error ten per cent damages on the sum due, with lawful interest, including the cost of the original suit and writ of error.(Toulmin's Digest, 1823). The records that are given to the Supreme Court for review include case descriptions, the charges, the names of the parties involved in the case, the names of the attorneys, the dates the cases were filed, and case file numbers. The clerk of the Supreme Court issues bills of costs or court fees along with orders to the county sheriff to collect the amount stated on the cost bills, in the name of the Supreme Court of Alabama. The cost bills list the name of the case, the name(s) of the person(s) from whom the money should be collected, the $ amount, the date, a list of fees (both court and sheriff's fees), and the clerk's signature. This series also consists of notes stating that the money for the court fees has been collected, court briefs, and court transcripts. Each case contains a case file number and often contains a page number to the record book in which the case was recorded, therefore these cases could be cross-referenced to the record books of the Supreme Court of Alabama.
